Terms of Service
1. Acceptance of Terms
By accessing or using Type The Voice (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
The Service is operated by Dzmitry Makarski, an individual based in Poland (“we”, “us”, “our”).
2. Description of Service
Type The Voice is a Telegram bot that receives voice messages forwarded by users and returns a text transcription. Transcription is performed using OpenAI’s Whisper API. The accuracy of transcriptions is not guaranteed and may vary depending on audio quality, language, and background noise.
3. Eligibility
You must be at least 13 years of age to use the Service, in line with Telegram’s minimum age requirement. By using the Service, you represent that you meet this requirement. If you are under 18, you must have parental or guardian consent.
4. Subscriptions and Free Trial
The Service offers paid subscription plans granting a monthly allowance of transcription minutes. New users receive a limited free trial allowance to evaluate the Service before purchasing.
Subscriptions are valid for 30 days from activation and do not auto-renew. Unused minutes do not carry over to the next billing period. When your subscription expires, access to the premium features ends and the free trial balance is not restored.
5. Payment
Subscriptions can be purchased using:
- Card payments — processed by Stripe, Inc. By completing a card purchase you confirm that you are authorised to use the payment method provided.
- Telegram Stars — a virtual currency within the Telegram platform. Purchases made with Telegram Stars are subject to Telegram’s Terms of Service.
All prices are displayed in USD and are inclusive of any applicable taxes unless stated otherwise.
6. Refund Policy
All purchases are final. We do not offer refunds.
EU/EEA consumers: Under EU Directive 2011/83/EU, consumers ordinarily have a 14-day right of withdrawal for digital services. By initiating a subscription and starting to use the Service, you expressly request immediate performance and acknowledge that you waive your right of withdrawal once the service has begun. This acknowledgement is made at the point of purchase.
Telegram Stars: Refunds for purchases made with Telegram Stars are governed by Telegram’s own refund policy and are outside our control.
If you believe you were charged in error, contact us at support@voice.message-r.com within 7 days of the transaction.
7. Acceptable Use
You agree not to use the Service to process, transmit, or store content that:
- is illegal under applicable law;
- infringes the intellectual property rights of others;
- contains private information about third parties without their consent;
- is used to harass, threaten, or harm others;
- attempts to reverse-engineer, scrape, or overload the Service.
We reserve the right to suspend or terminate your access without notice if we reasonably believe you have violated these rules.
8. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, third-party outages (including Telegram or OpenAI), or events beyond our control. We are not liable for any loss resulting from downtime.
9. Intellectual Property
The Service, its software, and associated materials are the property of Dzmitry Makarski. You retain all rights to the voice messages you submit and the transcriptions you receive. You grant us a limited, temporary licence to process your audio solely for the purpose of providing the transcription service.
10. Disclaimer and Limitation of Liability
The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy of transcriptions. To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 30 days preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after updated Terms are posted constitutes your acceptance of the changes.
12. Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland, without prejudice to your rights as a consumer under the mandatory laws of your country of residence.
